Odisha court refuses to stay order on demolition of Biju Samadhi

The civil judge court (junior division), Puri today declined to issue a stay on its earlier order asking the Puri district administration and municipal authorities to demolish the samadhi (memorial) of former  Odisha Chief Minister Biju Patnaik on the premises of Swargadwar, the Hindu cremation ground in the hily town.

The court, however, admitted a petition filed by the Puri district administration seeking review of its order.

In its December 27, 2014 order, the civil court had directed the Puri municipal authorities to demolish the  “encroachments and construction”, including the samadhisthal (memorial) of former Chief Minister Biju Patnaik at Swargadwar  within three months.

The court  had said if the authorities failed to remove the encroachments, the same would be done at the initiative of the court.

It had also directed the municipal authorities not to erect any structures, including memorials, pandals or statues, which might change the nature, character, location or extent of the land in question other than for public cause or for effective use of it by the community.
