The Odisha High Court has served notice to senior BJD leader and former minister Rabi Narayan Nanda seeking reply as to why criminal proceedings be not initiated against him on the charge of filing a false affidavit.
A single bench of Justice Biswanath Rath issued the directive after hearing a petition filed by senior Congress leader and Jeypore MLA Tara Prasad Bahinipati on Friday.
The petitioner had alleged that Nanda was scheduled to appear in the High Court as a witness in connection with an election related case. However, in an affidavit, he had sought more time from the court as he was advised by his doctor to take one-month rest since he was suffering from lungs complications.
“But the minister, during the period, had accompanied the chief minister in several programmes and collected the medical report on his lungs complications from a gynaecologist”, the petitioner alleged and prayed the court to take necessary action against Nanda for filing a false affidavit.
“As Nanda had filed the false affidavit to bid more time and submitted a false medical report as a document to the court, it should be treated as a punishable offence”, said Pitambar Acharya, counsel of Bahinipati.
