The Sub Divisional Judicial Magistrate (SDJM) court here on Friday granted bail to the youth—Sushant Nayak– accused of terrorising an Odisha secretariat staff with a knife about over a fortnight ago.
“The bail process was delayed as nobody from the accused’s side came forward to release him on bail. Some people arranged for the surety bond necessary for Sushant’s bail. Later in the afternoon, I submitted the court order to the Jharpada jail authorities,” Sushant’s counsel Sukanta Kumar Sahoo said.
Sushant was arrested on July 4 for allegedly brandishing a knife and threatening a lady staff in the secretariat here. Since then he was behind bars at Jharpada Special Jail here.
His widowed mother and ailing sister back home in Dhenkanal were worried for his bail. As there was nobody from his family to get him out on bail, Sushant’s bail was delayed, the lawyer said.
The court granted the bail after hearing Sushant counsels—Sukanta Kumar Sahoo and Ramachandra Behera— yesterday.
After media reports, a Baripada-based senior lawyer—Shantiranjan Behera—had come forward to release Sushant Nayak out on bail. However, he did not get the opportunity to contest the case.
As per court’s instruction, Sukanta Kumar Sahoo and Ramachandra Behera presented the case for Sushant.
Notably, Sushant was booked under section 452 of IPC (seven years’ imprisonment and fine, non-bailable), 353 for assault or criminal force to deter public servant from discharging his/her duty (two years’ jail or fine or both), 506 for criminal intimidation ( two years’ jail) and 341 for wrongful restraint (one month jail or Rs 500 fine).
