Refusal to file FIR again; CP asks Jatni IIC to probe

The Twin City commissioner of police has directed Jatni Police Station IIC Ranjit Kumar Prusty to immediately register an FIR and launch investigation in a case of harassment of a girl.

The commissioner’s order came after the mother of the girl, Rani Behera of Arisala village under Jatni police limits in Khurda district, complained that the OIC at Janla outpost had refused to register her FIR when she with her complaint to him yesterday.

Behera also lodged a complaint in this regard with the Scheduled Caste/Scheduled Tribe Commissioner and the State Women’s Commission on Friday.

In her complaint, Rani allged that Krushna Chandra Nayak, a local youth, abused her daughter Malati and passed casteist remarks against her while was on her way to college on Tuesday.

“When I asked Krushna about it the next day, he abused me too. The same night, Krushna, along with a few other youths, forcibly entered my house armed with weapons and threatened me of dire consequences if I went to the police,” Rani said.

She claimed that OIC at Janla outpost not only refused to register her complaint, but also misbehaved with her.

“Today I submitted a petition to the Scheduled Caste/ Scheduled Tribe Commissioner, Twin City Commissioner and State Women Commission and requested them to provide justice to my family and get the culprits arrested,” said the harassed mother.

    Dear All,
    The best way to get the complaint registered and get the copy of the FIR:-

    1. Write the complaint and keep one copy of it with you.

    2.Send the original copy of the complaint to IIC of the Police Station and a copy to the concerned SP by SPEED /REGISTERED POST.

    3. After two days ask the information under RTI act 2005 (by SPEED / REGISTERED POST) regarding details of action taken by the Police Station after receiving the complaint [like (a) On which date the complaint reached P.S (b).Who received the Speed Post Complaint (c) On which date and time the FIR was registered by police (d) Name of the IO (e) On which date the FIR Copy is provided to the Complaint (f) Provide the Photostat Copy of the FIR]

    you will find that your complaint will registered by the police and you need not to run to the Police Station for days together to register a complaint and need not to pay bribe to any corrupt police official for registering one complaint.

  2. The Supreme Court on 12.11.2013 made it mandatory for police to register a first information report on receiving a complaint about a serious offence, freeing criminal investigation from the rampant abuse of discretionary powers by the local thana in-charge.

    “If discretion, option or latitude is allowed to the police in the matter of filing of FIRs, it can have serious consequences on the public order situation and can adversely affect the rights of the victims, including violation of their fundamental right to equality,” said a five-judge constitution bench of Chief Justice P Sathasivam and Justices B S Chauhan, Ranjana P Desai, Ranjan Gogoi and S A Bobde.
