The Odisha Public Service Commission (OPSC) has challenged State Administrative Tribunal (SAT)’s order on the merit list of candidates drawn by it on the basis of the results of Odisha Administrative Service (OAS)-2011 preliminary examinations and has sought its quashing by the Odisha High Court.
The OPSC has in a petition filed before the High Court on Thursday called SAT’s order asking it to cancel a merit list prepared by it on the basis of the results OAS-2011 preliminary examinations as unconstitutional and illegal.
The OPSC said as per rules the hearing in such cases should have been done by a division bench which has not been done in this case. A single member bench of the SAT with acting chairman of SAT in it had conducted the hearing in the case.
Similarly after conducting a hearing in a misc case and issuing an interim order SAT has instead completed its hearing on the original application which is a violation of the rules, the OPSC said.
